Dinsmore Successfully Defends Infrastructure Company in Tragic Wrongful Death Case

After three years of intense litigation, a Dinsmore team of attorneys led by Pittsburgh-based partner John Berry secured summary judgment for its client in a multi-million dollar wrongful death case.

The case involved the tragic drowning death of a young child at an apartment complex in Broward County, Florida.  Dinsmore defended an infrastructure management company that was contracted to perform work at the private property where the incident occurred.

In a case involving numerous parties and difficult legal and factual issues, the Plaintiffs argued that Dinsmore’s client had an obligation to ensure that the property was safe and should also have identified and corrected areas of the property that did not comply with local building or safety codes. 

John and his team were able to establish that their client was not responsible for code or compliance issues at a property it did not own, design or construct, and that no evidence suggested that its work caused the death.

In July of 2024, the Circuit Court for Broward County, Florida granted summary judgment in favor of Dinsmore’s client, dismissing all claims with prejudice.

Dinsmore associates Yesica Liposky and Dan Smolsky also played key roles in the successful defense of this challenging case.
